Your consent and consent and the provisions of this Electronic Communications Agreement remain in effect with respect to your PEX Account until (1) you revoke your current consent by revoking your intention to withdraw your consent by telephone at 1-866-685-1898 and an after-sales service manager or send us in writing to: Thank you for your interest in Prepaid Expense Card Solutions, Inc. d/b/a PEX. PEX is a paperless program. We need your email address to ensure that we can communicate effectively with you and provide you with our services. We also need your consent to provide you with important account-related information and updates electronically rather than on paper. In order for PEX to provide you with the PEX Service and also to send you legal advice and other messages relating to your PEX Account, including those that would otherwise have to be made available to you on paper, you must electronically agree to the terms of this Statement of Publication and Consent for Electronic Signatures and Electronic Communications (“Electronics Communications Agreement”). This agreement provides that you agree that your electronic consents given on documents with PEX have the same legal effect as if you had signed the documents with a pen. They also agree, to the extent permitted by law, to obtain electronically communications and communications relating to PEX. You agree to print or download to your computer, mobile or other communication device (provided that your device has such functionality) by clicking “Print” or “Download” and keeping a copy of this Electronic Communications Agreement. You also agree to print or download and retain a copy of all other documents relating to the PEX Service that you electronically accept.
You also agree to print or download and retain copies of all messages in our account. You can update your email address or primary address at any time by logging into the PayPal site, going to “My Account” and selecting the “Profile” tab. If your email address becomes invalid, so that email messages sent to you by PayPal are returned, PayPal may reveal that your account is inactive and you may not be able to perform activities with your account PayPal until we collect a valid and functional primary email address from you. We may provide account messages in electronic form by any combination of (1) email; (2) publish or make them available on the PEX website; and/or (3) give you the option to download or print a PDF file. (“PDF” refers to the portable document format created by Adobe Systems Inc.®). You agree and are responsible for immediately verifying account messages provided in electronic form and for taking any necessary actions or actions requested of us within the time limits set out in such notice. Without limiting the foregoing, you agree that if we send you an email or other message indicating that an account communication has been posted or provided on the PEX website, you will immediately verify such account communication. You may revoke your consent to receive notifications electronically by writing to us in writing at “Attn: Electronic Communications Delivery Policy, P.O. Box 45950, Omaha, NE 68145-0950” or by contacting us via the “Contact” link at the end of each page of the PayPal site. If you do not provide or revoke your consent to receive electronic messages, PayPal reserves the right to either refuse your account request, restrict or deactivate your account, close your account and any sub-accounts (for example. B a student account) or charge you an additional fee for the hard copy. We will notify you if there are material changes to the hardware or software necessary to receive electronic communications from PayPal.
By giving your consent, you confirm that you have access to the necessary devices and that you are able to obtain, open and print or download a copy of the communications for your documents.. . . .
